TWO PARTS TO DOMESTIC ASSAULT CASES
The complexity of domestic assault cases is often compounded by the fact that hearings may involve two separate courts, the family court and criminal court. If the complaining party calls the police, then the defendant will be brought before the criminal court, an order of protection will be issued and an application for bail will be heard by the court. If the complaining party goes to family court first, then the family court will issue restraining orders or orders of protection. The court may grant a restraining order even if you are not present at this hearing.
The criminal court will handle the criminal side of the case, and a conviction in the criminal court may result in probation, heavy fines, a jail sentence and/or a prison sentence. I will do my best to help you with the criminal case. If family court representation is required, then I will refer you to another attorney for the family court portion.
