Earlier this month in a New York City subway station, Scout Willis, the daughter of Demi Moore and Bruce Willis was arrested for underage drinking and using a fake driver’s license. The 20-year-old Brown University student was released on her own recognizance without having to post bail and ordered to appear in criminal court on July 31.
According to the criminal complaint filed by transit police, they saw her drinking a beer in the subway station at about 7 p.m. on Monday, June 4. The officer asked for her ID and she handed him a driver’s license that belonged to someone else. Upon further questioning, Willis told the transit cop her real name and admitted that the ID was not hers. She eventually handed the officer her actual driver’s license.
She was arrested, charged with two misdemeanors of criminal impersonation and having an open container of alcohol in a public place. She was allowed to leave the police station with a desk appearance ticket (DAT) and return home. A DAT is an order to appear in county court for an arraignment and is an administrative form of arrest; without having to undergo booking and incarceration
Thankfully, Scout was not driving. But the penalty for using a fake ID in New York is the suspension of your driver’s license. The person who sold the beer to her may also be held liable in this case. According to New York’s Alcohol Beverage Control Law, you cannot claim that the underage person appeared to be someone who was of age.
